harassment in the workplace has risen to the forefront of media and legislative focus.
There is also a growing intolerance even for conduct that might previously have been
tolerated because it did not rise to the level of legal harassment. In April, New York
passed laws designed to make it harder for businesses to require arbitration of sexual
harassment claims or to settle those with confidentiality clauses. Soon, all New York
employers will be required to have in place a written anti-harassment policy, to provide
employees with a standard complaint form, and to conduct annual anti-harassment
